The Bundesanstalt für Materialforschung und -prüfung (BAM) publishes data on dangerous goods in the form of files and a search application on https://tes.bam.de and https://dgg.bam.de within the framework of these Terms of Use as a source of continued reference and for further use and distribution by members of the public, industry, media, science and other institutions. Further use of the data is simplified by standardised and transparent Terms of Use.

Terms of Use
- The “Data licence Germany - attribution - Version 2.0” (Datenlizenz Deutschland - Namensnennung - Version 2.0) shall apply to the data records, unless specified otherwise.
- The attribution of the Bundesanstalt für Materialforschung und -prüfung (BAM) as the rights holder for content licensed with attribution is to be given as follows: "Source: Bundesanstalt für Materialforschung und -prüfung (BAM) – Datenbank GEFAHRGUT – URL: https://tes.bam.de/TES/Navigation/EN/DGG-Database/dgg-database.html".
- The use of the logos of the Bundesanstalt für Materialforschung und -prüfung (BAM) is prohibited.
- The use of the published data on dangerous goods for publications or applications that support or incite criminal, illegal, discriminatory, defamatory, racist, pornographic, sexist or homophobic activities or violate applicable law is prohibited.
- Any works suspected of infringing copyrights, exploitation rights, individual rights or other rights may be rectified or erased immediately at any time without consultation.

No liability shall be accepted in respect of the data and services provided. This applies in particular to whether they are up to date, correct, available or complete as well as to their compatibility and interoperability with the systems operated by the user.
The disclaimer shall not apply to statutory claims for damages for injury to life, limb or health, nor shall it apply to statutory liability for other damages where said damages are based on breach of duty through deliberate intent or gross negligence.
Restrictions on use under section 44b of the German Copyright Act (Urheberrechtsgesetz – UrhG)
The protection of content subject to copyright is becoming increasingly important in view of the rapid pace of the development of artificial intelligence and automated analysis methods (text and data mining – TDM). TDM is essentially permitted under section 44b of the German Copyright Act (Urheberrechtsgesetz – UrhG) except where subject to express legal restrictions. In order to prohibit the automated use of the content provided on this website for TDM and to protect the rights of the authors, the Bundesanstalt für Materialforschung und -prüfung (BAM) hereby declares a restriction on its use under section 44b (3) UrhG (see below).
Use of the content provided by the Bundesanstalt für Materialforschung und -prüfung (BAM) on https://tes.bam.de and https://dgg.bam.de for text and data mining within the meaning of section 44b of the German Copyright Act (Urheberrechtsgesetz - UrhG) is prohibited.
Any automated processing, analysis, reproduction or other use of the content for text and data mining purposes shall be strictly subject to express prior consent issued in writing by the Bundesanstalt für Materialforschung und -prüfung (BAM).
Data licence Germany – attribution – version 2.0
Any use will be permitted provided it fulfils the requirements of this "Data licence Germany – attribution – Version 2.0".
The data and meta-data provided may, for commercial and non-commercial use, in particular
- be copied, printed, presented, altered, processed and transmitted to third parties;
- be merged with own data and with the data of others and be combined to form new and independent datasets;
- be integrated in internal and external business processes, products and applications in public and non-public electronic networks.
The user must ensure that the source note contains the following information:
- the name of the provider,
- the annotation "Data licence Germany – attribution – Version 2.0" or "dl-de/by-2-0" referring to the licence text available at www.govdata.de/dl-de/by-2-0 and
- a reference to the dataset (URI).
This applies only if the entity keeping the data provides the pieces of information 1-3 for the source note.- Changes, editing, new designs or other amendments must be marked as such in the source note.
